80% Lowers...

Post by sWamp-Ass on Sun Jul 29, 2012 5:48 pm

*PLEASE READ LEGALITIES DON'T SPREAD FEAR * TO BE LEGAL IN CALI IT MUST START AS A SINGLE SHOT WITH AN OVERALL LENGTH OF10.5 INCHS. YOU CAN LATER MODIFY IT AS YOU WISH . IF IT IS EVER SOLD IT MUST BE REGISTERED. IF IT IS SOLD IN CALIFORNIA -IT MUST BE SOLD AS A SINGLE SHOT AS IT IS ILLEGAL TO BUILD MANUFACTURE A HANDGUN FOR SALE IN CALI -WITHOUT HAVING IT TESTED BY STATE LABS FOR SAFETY ISSUES. the exemption being it is a single shot.

WARNING:
IF YOU ALREADY OWN AN AR RIFLE THAT IS NOT REGISTERED AS AN SBR, DO NOT ORDER A PISTOL KIT UNTIL YOU HAVE FINISHED (AN 80%ER) OR PURCHASED A COMPLETE LOWER THAT WAS 4473'D AS "PISTOL" OR "OTHER". IF YOU OWN A SHORT BARRELED UPPER AND A RIFLE WITHOUT OWNING THE PISTOL LOWER, YOU CAN BE CHARGED WITH CONSTRUCTIVE POSSESSION OF AN UNREGISTERED SBR IF CAUGHT. THAT IS A FELONY OFFENSE AND I BELEIVE 10 YEARS IN PRISON.
Here is a great link for more info and items necessary to complete your 80%er. thanks for the link (vampyrehunterD)

LEGALITY OF BUILDING YOUR own gun straight from GCA 1968- scroll down to page 177

"(A6) Does the GCA prohibit anyone
from making a handgun, shotgun
or rifle?
With certain exceptions a firearm
may be made by a nonlicensee provided
it is not for sale and the maker
is not prohibited from possessing
firearms. However, a person is prohibited
from assembling a nonsporting
semi-automatic rifle or nonsporting
shotgun from imported parts. In addition,
the making of an NFA firearm
requires a tax payment and approval
by ATF. An application to make a
machinegun will not be approved
unless documentation is submitted
showing that the firearm is being
made for a Federal or State agency.

home built form 1 exemption is confirmed in the tech branch letter below
http://firearmsfreedomact.com/BATF%20Marbut%20Response%20Letter.pdf
the important text follows
"As a first matter, the manufacture of firearms, ammunition, and firearms accessories for your personal use does generally not require licensure under the Federal Gun Control Act of 1968, as amended (GCA). if the firearm, however, is of a type that is defined under 26 U.S.C Section 5845(i.e., a National Firearms Act firearm),you will need to file an ATF form 1, and have it approved by ATF prior to manufacture."

The 2nd Amendment doesn't open by saying any of these six things:

- In order that citizens can be capable of maintianing balance amoung the wild creatures, the right of the people ...

Because being known as the home of fine marksmen is a high honor among nations, the right of the people ...

In order to assure the provision of meat for their families, the right of the people ...

As all citizens should be equipped to stave off attack by criminals, the right of the people ...

In order to provide a means of recreation to any who desire it, the right of the people ...

Nope ...

It says," A well regulated militia being NECESSARY to the security of a free state, the right of the people ...

Militia is a military term that means an armed citizenry capable of warlike action.
Well regulated means that force is equipped with weaponry appropriate to the task of making war, and it's members are practiced in the use of them.
